1. Purpose of this consent
You are authorising the firm named above ("the Firm") and its appointed service provider ClearSlate to act on your behalf in identifying and disputing prescribed debt listings on your credit record.
2. What is prescribed debt?
Under the Prescription Act 68 of 1969, most debts prescribe (become legally unenforceable) three years after your last payment or written acknowledgement, provided no court action was taken. Under Section 126B of the National Credit Act 34 of 2005, credit bureaus must remove listings relating to prescribed debts.
3. What we will do
- Request your consumer credit reports from TransUnion, Experian (including Compuscan) and XDS
- Analyse each listed account to identify debts that have prescribed
- Prepare and submit formal dispute letters to the relevant credit bureaus
- Track bureau responses and follow up until each dispute is resolved
- Escalate to the Credit Ombud where a bureau fails to respond within 20 business days
4. Your personal information (POPIA)
In terms of the Protection of Personal Information Act 4 of 2013, we will collect and process your name, identity number, contact details and credit information solely for the purpose described above. Your information will not be sold or shared with any party other than the credit bureaus and regulators involved in your disputes. You may withdraw consent at any time by contacting the Firm, after which no further processing will occur.
5. Important notices
- We will never acknowledge any debt on your behalf โ doing so could restart the prescription period
- We do not provide legal advice; for complex matters you may consult an attorney
- Certain debts do not prescribe after 3 years: home loans, court judgements, municipal debt, TV licences, and SARS tax debt
- Removal of a listing does not extinguish a debt that has not prescribed
6. Record of consent
Your typed name, ID number, signature, the date and time, and your device's IP address will be securely recorded as proof of consent.
